The U.S. Nuclear Regulatory Commission (NRC) is conducting a license renewal review of Pacific Gas and Electric Companys (PG&E) Diablo Canyon Power Plant, Units 1 and 2 (DCPP).
DCPP is located near Avila Beach, in San Luis Obispo County, California. The purpose of this letter is to re-initiate Section 106 consultation with the California Office of Historic Preservation (OHP), under the National Historic Preservation Act (NHPA). This letter also provides requisite information outlined in OHPs Detailed Recommendations for Section 106 Consultation Submittals (see Enclosure 1).
On July 1, 2015, the NRC notified OHP of its intent to reopen scoping for the license renewal of DCPP under the National Environmental Policy Act (NEPA) process and requested OHP participation. In this letter, the NRC also explained that it intends to comply with Section 106 through the NEPA process, pursuant to Title 36 of the Code of Federal Regulations (CFR) 800.8©.
For the purposes of analysis, the NRC has defined the area of potential effects (APE) for the DCPP license renewal undertaking as the DCPP site and the north and south access roads and immediate environs that may be impacted by ongoing routine maintenance and operations activities during the license renewal term (see Enclosure 2). The APE may extend beyond the immediate DCPP environs if PG&Es maintenance and operations activities affect offsite historic properties. This determination is made irrespective of ownership or control of the lands of interest.
As you are probably aware, extensive archaeological surveys have been conducted at DCPP within the APE and the findings are on record with OHP in the California Historical Resources Information System (CHRIS). The NRC plans to summarize this information in the draft EIS when describing historic properties within the APE at DCPP. Sensitive cultural resource site location information at DCPP will not be disclosed in the draft EIS per Section 304 of NHPA that provides protection of information about a historic property that might result in harm to the

The NRC will also describe ongoing routine maintenance and operations activities that have the potential to affect historic properties and other cultural resources at DCPP as well as all consultations with American Indian tribes. The NRC has requested and received a list of Tribal contacts from the California Native American Heritage Commission.
The NRC is aware that OHP previously requested a Programmatic Agreement and a Historic Properties Management Plan from PG&E. PG&E is working on these documents and has indicated that both will be provided to OHP for review and comment.
