In June 2012, the NRCs 2010 Waste Confidence Decision (Reference 1) was vacated by the U.S. Court of Appeals for the District of Columbia Circuit (Reference 2). As a result of the Courts action, the NRC issued an Order (Reference 3) that effectively precludes final licensing decisions from being made when such decisions are contingent upon the conclusions of the Waste Confidence Decision. Proceedings affected by this Order include WBN Unit 2 for which TVA is currently seeking an operating license under
