The licensee responded to the Notice in a letter dated November 27, 1985. After careful consideration of the licensee's response, the staff has concluded that the violations did occur as set forth in the Notice of Violation and Proposed Imposition of Civil Penalty. However, upon further consideration that the licensee identified and reported two of the four openings and that it has undertaken comprehensive corrective actions, the staff concludes that a 50 percent reduction in the base civil penalty is warranted. Accordingly, an Order Imposing Civil Penalty in the amount of Twenty-five Thousand Dollars has been issued today.
