License Termination, Big Rock-Point Nuclear Plant, Hayes -Township, Charlevoix County (NRC, Docket 50-155, NRC License DPR-6)

Dear Mr. Shepherd:

Under the authority of Section 106 of the National Historic Preservation Act of 1966, as amended, we have reviewed the License Termination Plan prepared by Consumers Energy Company for the Big Rock Point Nuclear Plant. It is our opinion that the Big Rock Point Nuclear facility appears to meet the criteria for listing in the National Register of Historic Places.

Additionally, sites within the Big Rock Point property boundary (sites 20CX170 and 20CX177, respectively) also appear to meet the National Register criteria.

By letter of October 18, 2004, we notified you that the proposed action would have an adverse effect on historic properties within the project's area of potential effects. As you are aware, since that time the SHPO, NRC and Consumers Energy Company have consulted to address the effects of the undertaking and potential mitigation alternatives. Based on the nature of project and the limits imposed on potential alternate uses for the affected facility by the NRC's own regulations (10 CFR Part 50.82), we accept the purpose and need for the proposed undertaking. To mitigate the adverse effects of the proposed undertaking on the above-cited cultural resources, the SHPO expects to enter a Memorandum of Agreement (MOA) with the NRC, with Consumers Energy Company as a consulting party, in early 2005.
