Dear Mr. Flanders:

Thc Durham County Board of Commissioners had previously submitted thc attached Resolution regarding thc proposed expansion of high-level radioactive waste storage facilitics at Carolina Power 8c, Light's Shcaron Harris Nuclear Power Plant in Wake County, North Carolina. ln this Resolution, the Board expressed concern over these plans and requested that a public input process bc put in place prior to approval of this application, As pcr the Nuclear Regulatory Commission's rules, the public comment period is only thirty (30) days from the date of the request. In this case, the final date for comment is Friday, February 12.-

The Durham County Board of Commissioners respectfully requests an extension of thirty (30) days for this public comment period so that they can provide informed remarks on this issue. Thc Board has serious concerns over this application and believes that the thirty (30) day period is too short to allow adcquatc public input and for thc County Commissioners to review this issue.

~ I DURHAM COUNTY BOARD OF COMMISSIONERS A RESOLUTION REGARDING PROPOSED EXPANSION OF HIGH LEVEL RADIOACTWE WASTE STORAGE FACILITIES AT CP&L'S SHEAROVi HARRIS NUCLEAR POWER PLANT WHEREAS, on January 3, l999, the Durham County Board of Commissioners was advised as to plans for the expansion of the high level radioactive waste storage facilities at Carolina Power &

I.ight,'s Shearon Harris nuclear power plant in Wake County; and WHEREAS, the Board of County Conunissioners has been apprised of the potential risks inherent with the doubling of the storage capacity of thc temporary storage pools for high level radioactive waste for the purpose of long-term storage of high level radioactive waste, not only from the Shearon Harris plant, but also from two other nuclear power plants from elsewhere in North and South Carolina; and WHEREAS, the Durham Board of County Commissioners is concerned about the plans to expand the waste storage capacity at, the Shearon Harris facility and the lack of public input and process thus far:

NOW, THEREFORE BE IT RESOLVED that the Durham County Board of Commissioners r'equests that the North Carolina Department of Environment, Health, and Natural Resources and the Nuclear Regulatory Comnussion conduct public hearings in which Carolina Power & Light and appropriate regulatory staff: 1) explain the plans to expand the storage facilities for high level radioactive waste at the Shearon Harris nuclear power plant; 2) outline the risks or hck thereof and explain the risk assessment methodology employed to develop risk projections related to the use of facilities designed for short-term storage of high level radioactive wastes for long-tenn storage; 3) outline the risks or lack thereof and explain the risk assessment methodology employed to develop risk projections associated with the transportation and handling of materials from other distant nuclear power generating facilities; and 4) accept and consider public comments relative to support for or opposition to operating or expanding such a facility in this area.

BE IT FURTHER RESOLVED that copies of ths resolution are to be sent to th" Nuclear Regulatory Commission; North'Carolina's delegation to the United States Congress; Durham County's local delegation to the North Carolina Legislature; North Carolina Department of Environment, Health, and Natural Resources; Carolina Power & Light; and Durham City/County Environmental Affairs Board.
