Dear Mr. Ogata:
By letter dated September 30, 2010, Mitsubishi Heavy Industries, Ltd. (MHI) submitted revisions to the Software Program Manuals (SPMs) as a commitment made in your August 27, 2010, closure plan letter (ML102430180) to resolve one of the key issues associated with the US-APWR instrumentation and control (I&C) system. The U.S. Nuclear Regulatory Commission (NRC) has completed an assessment of the extent to which these submittals resolved the identified staff concerns during the earlier interactions.
Based on this review, the NRC staff has found that the revised SPMs do not resolve the cited information needs and remain unacceptable to commence a detailed NRC staff review. When the SPMs fully address the NRC staff guidance, staff will establish a schedule and commence
the review.
Much of what was done in the revised SPMs do not address the underlying NRC staff issues. The SPMs will require significant modifications before a detailed technical review can commence to ensure the software used in the I&
C safety system will be developed to perform the applicable safety functions under design basis conditions and to support a finding that it will meet the applicable regulations (i.e., Title 10 of the Code of Federal Regulations (10 CFR), Part 50.55a(a)(1), 10 CFR 50.55a(h), and the criteria of 10 CFR Part 50, Appendices A and B as they extend to include the software elements).
As discussed during the previous interactions and in a number of NRC staff requests for additional information, the submitted SPMs are not written with sufficient specificity and completeness. The SPMs do not contain the information regarding the special controls and processes necessary to attain the required quality criteria to demonstrate compliance with the applicable regulations cited above. Contrary to the MHI position stated in Chapter 1 of the Design Control Document that it has "conformance with no exceptions" for the software planning phase, the NRC staff has concluded that the material submitted in the SPMs can support no such conclusions. Further, as submitted, the SPMs do not comply with 10 CFR 52.47(a)(9) since they neither address significant aspects of the applicable NRC staff guidance in Standard Review Plan Branch Technical Position 7-14, nor provide acceptable alternatives for those areas that are not in accordance with the NRC staff guidance.
The NRC staff has identified examples of some of the issues, discussed in the enclosure, that need to be addressed before the detailed technical review can proceed. The examples are not a complete list of the NRC staff issues. It is MHI's responsibility to perform a comprehensive analysis of the SPMs to ensure that their next revisions will be of sufficient quality and content to fully demonstrate conformance to the applicable regulations.
The NRC is willing to work closely with MHI to find an appropriate resolution path for this issue in future interactions.
During the December 10, 2010, public meeting, the NRC staff and MHI discussed this issue. In
that meeting, MHI stated that it plans to submit the revised SPMs by January 31, 2011. Upon NRC staff suggestion, MHI agreed to share a couple of sections of the SPMs by early January 2011, for early NRC staff feedback. Once the revised SPMs are received, the NRC staff will again perform an assessment of the extent to which these submittals resolved the identified concerns.
Pursuant to 10 CFR 2.390, the NRC has determined that the enclosure may contain proprietary information or other categories of information that should be withheld from public disclosure.
The NRC will delay placing this document in the public document room for a period of 30 days from the date of this letter to provide MHI with the opportunity to comment on information in the enclosure that should be withheld from public disclosure. If MHI believes that any information in the enclosure should be withheld from public disclosure, please identify such information line by line and define the basis pursuant to the criteria of 10 CFR 2.390. Based on MHI's response, proprietary information will be redacted from the version that will be made publicly available.
