The purpose of this letter is to transmit Nebraska Public Power District's (NPPD) response to Condition III.C.2 of the Nuclear Regulatory Commission's (NRC) Order dated April 29, 2003, "Issuance of Order for Compensatory Measures Related to Fitness-For-Duty Enhancements Applicable to Nuclear Facility Security Force Personnel," EA-03-038.

In response to the events of September 11, 2001, NPPD, on its own and in response to NRC Advisories, Orders and industry initiatives, promptly initiated and has maintained heightened security measures at Cooper Nuclear Station to continue to provide high assurance that activities involving special nuclear material are not inimical to the common defense and security and do not constitute an unreasonable risk to the public health and safety in the current threat environment.

On April 29, 2003, the NRC issued three orders requiring additional compensatory measures as prudent to address the current security threat environment. NPPD, in its response to Order EA-03-038 (Compensatory Measures Related to Security Force Training and Fitness-For-Duty) dated June 3, 2003, stated "NPPD will immediately start implementation of the requirements in COOPER NUCLEAR STATION P.O. NLS2003113 Page 2 to Order EA-03-038, and will be in compliance per the schedule outlined in response to Item II.C.l ;" i.e., by October 29, 2003.

As required by Condition 1I.C.2 of the Order, NPPD hereby notifies the NRC that full compliance with the requirements described in Attachment 2 of the Order has been achieved as of the date of this letter. Security staffing levels support the work hour limits and required monitoring programs are in place to demonstrate continuing compliance.
