REQUEST FOR WITHHOLDING PROPRIETARY INFORMATION FROM PUBLIC DISCLOSURE - FRAMATOME RESPONSE TO REQUEST FOR ADDITIONAL DOCUMENTS TO BE DOCKETED FOR THE REVIEW OF ANP-10357P, REVISION 0, TXS COMPACT TOPICAL REPORT (EPID L-2024-TOP-0029)

letter dated August 14, 2025, Framatome Inc. (Framatome) submitted an affidavit (Agencywide Documents Access and Management System (ADAMS) Accession Nos. ML25226A235) executed on August 14, 2025, by Philip Opsal, to the U.S. Nuclear Regulatory Commission (NRC) requesting that the information contained in the following document be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR), Section 2.390, Public inspections, exemptions, requests for withholding:

Framatome Document 56-9141754 -012, entitled, Framatome Inc. Quality Assurance Program, dated January 19, 2023.

This submittal can be found in ADAMS Package Accession No. ML25226A233. The entire document is considered proprietary by Framatome; therefore, a non-proprietary version was not submitted.

The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

a) Use of the information by a competitor would permit the competitor to significantly reduce its expenditures, in time or resources, to design, produce, or market a similar product or service.

b) The information is vital to a competitive advantage held by Framatome, would be helpful to competitors to Framatome, and would likely cause substantial harm to the competitive position of Framatome.

The NRC staff has reviewed the affidavit and the material in accordance with the requirements of 10 CFR 2.390 and based on the statements in the affidavit, it has determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.

Therefore, the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, Framatome should promptly notify the NRC. Framatome also should understand that the NRC may have cause to review this determination in the future if, for example, the scope of a Freedom of Information Act request includes Framatome information. In all review situations, the NRC will follow applicable laws, regulations, and policies in conducting its review, including the NRCs policies on notifying the owner of information in advance of any public disclosure.
