On July 17 and August 25, 2025, meetings were held between the NRC staff and representatives of Oklo Inc. (Oklo). The purpose of the meetings was to discuss Oklo's planned pre-construction activities for its proposed reactor at the Idaho National Laboratory (INL) site and to discuss the path forward for any regulatory actions needed.
After the August 25 meeting, Oklo revised its plans related to the scope of activities that would be designated as pre-construction, and on August 28, 2025, the NRC issued SECY 25-0074, Expedited Construction of Certain Structures, Systems and Components. The purpose of the December 1, 2025, meeting was to discuss the changes in scope proposed by Oklo and to discuss how the positions in SECY 25-0074 impact the staffs determination on how these activities would be classified.
The staff stated that, consistent with the guidance in SECY 25-0074, if structures containing balance-of-plant systems are considered non-safety-related and their failure would not directly cause a reactor scram or actuation of a safety system, and an assessment of their significance determines that their effect on public health and safety is so low as to be considered negligible, then those structures would not be considered within the definition of construction under 10 CFR 50.10(a)(1)(iv). Based on these presumptions, the pouring of foundations and walls associated with those structures would not be construction. However, the staff has not evaluated Oklos classification of structures, systems, and components or an associated methodology and therefore cannot definitively state whether construction of the turbine building would be considered construction under 10 CFR 50.10.
The staff also noted Oklos determination that the installation of support systems for worker safety during excavation of the reactor and administrative buildings would not have a direct effect on radiological safety was plausible. Based on this presumption, the support system installation would not be considered as construction under 10 CFR 50.10. However, the staff has not evaluated the impact of the support systems on radiological safety and therefore cannot definitively state whether their installation would be considered construction under 10 CFR 50.10.
No regulatory decisions were made as a result of this meeting.
