December 8, 2023 U.S Nuclear Regulatory Commission Ref: Docket# 70-398 Attn: Document Control Desk License No. SNM-362 Washington, DC 20555-0001 TAC No. L32643 Mr. Osiris Siurano-Perez Project Manager, Fuel Facility Licensing Branch Division of Fuel Management Office of Nuclear Material Safety and Safeguards U.S. Nuclear Regulatory Commission Washington, DC 20555-0001

Subject:

Request for additional time to provide the technical response to the RAIs associated with the 2022 Triennial update to the NIST Decommissioning Funding Plan with Project ID L-2022-DFA-0010

Dear Mr. Siurano-Perez,

The purpose of this submittal is to request an additional 30-day extension (totaling 120 days) to provide technical responses to the RAIs communicated to NIST in your letter dated September 12, 2023. The extension request is due to the need for careful review by the NIST General Counsels office required for documents signed by the NIST Director. We are confident that this review can be completed, and all documents finalized, with the requested 30-day extension beyond the current deadline.

Please contact Mr. Manny Mejias at 301-975-5022 or manny.mejias@nist.gov if you have any questions concerning this RAI response extension request.

Sincerely, Elizabeth A. Mackey, Ph.D.
