DEPARTMENT OF COMMERCE, NATIONAL INSTITUTE OF STANDARDS AND TECHNOLOGY 2022 TRIENNIAL UPDATE TO DECOMMISSIONING FUNDING PLAN - ENTERPRISE PROJECT IDENTIFICATION NUMBER L-2022-DFA-0010

Dear Dr. Elizabeth A. Mackey:

The U.S. Nuclear Regulatory Commission (NRC) staff has received and considered the U.S.

Department of Commerce, National Institute of Standards and Technologys (NISTs) submittal dated December 8, 2023 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML23355A255). In its submittal, the NIST requested a 30-day extension to the due date of December 12, 2023, for providing its responses to the NRC staffs, September 12, 2023, request for additional information (RAI, ML23221A355) regarding the NISTs triennial update to its Decommissioning Cost Estimate and Decommissioning Funding Plan (DCE/DFP).

The NRC staff is granting the request. Therefore, NIST should provide its responses within 120 days from the date of the RAI letter (i.e., by January 11, 2024). Please note that because of this extension, the NRC final response on the updated DCE/DFP will now be rescheduled from February 2024 to March 2024. The NRC staff does not expect changes to the estimated hours (80). However, we will promptly communicate any significant changes to this schedule and/or estimated hours.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter and the enclosure will be available electronically for public inspection in the NRC Public Document Room (PDR) or from the Publicly Available Records component of the NRCs ADAMS. The ADAMS database is accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html.
