SUBJECT:

2022 TRIENNIAL UPDATE TO DECOMMISSIONING FUNDING PLAN

By letter dated September 27, 2022 (Agencywide Documents Access and Management System (ADAMS) Accession Number ML22293A269), in accordance with the requirements in Title 10 of the Code of Federal Regulations (10 CFR) Paragraph 70.25(e)(2), the Department of Commerce, National Institute of Standards and Technology (NIST), provided its 2022 triennial update to its decommissioning funding plan for its facility in Gaithersburg, Maryland. The U.S.

Nuclear Regulatory Commission (NRC) staff identified the following information that is needed to complete its acceptance review of NISTs submittal, and for proceeding with a detailed technical review.

1. Identification and justification for using the key assumptions contained in the decommissioning cost estimate (DCE).

Issue:

NIST indicated that it has previously provided cost estimate details as attached spreadsheets in its September 2016 submission, and that these spreadsheets have been updated to reflect current cost estimates. However, the updated spreadsheets were not included in its 2022 DFP/DCE update submittal.

Regulatory Basis:

The regulations in 10 CFR, Paragraph 40.36(d)(1)(ii), require, in part, that each decommissioning funding plan must be submitted for review and approval and must contain identification of and justification for using the key assumptions contained in the DCE

Request:

Provide the updated cost estimate details spreadsheets (Appendix B of the 2022 submittal).

This information is necessary for the NRC staff to complete the acceptance review of NISTs September 27, 2022, submittal.
