Dear Dr. Elizabeth Mackey:

By letter dated January 24, 2023 (Agencywide Documents Access and Management System

[ADAMS] Accession Number ML23060A262), you provided the Department of Commerce, National Institute of Standards and Technology (NIST), responses to the U.S. Nuclear Regulatory Commission (NRC) staffs request for supplemental information (RSI) dated December 17, 2022 (ML22348A170). The RSI was issued to request information needed to determine whether the September 27, 2022, submittal (ML22293A269) providing the NISTs triennial update to its Decommissioning Funding Plan, could be accepted for detailed technical review.

The NRC staff has completed its review of your responses to the RSI and has determined that the responses do not fully address the information requested. However, in your letter, you stated that NIST has engaged in a procurement effort to have a new decommissioning cost estimate (DCE) completed in April 2023, which NIST intends to share with the NRC as soon as it is completed. Therefore, because you intend to provide additional supplemental information to support your submittal, the NRC staff is placing the technical review of the September 27, 2022, submittal on hold pending the receipt and evaluation of the new DCE.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS. The ADAMS database is accessible from the NRC website at http://www.nrc.gov/reading-rm/adams.html (the Public Electronic Reading Room).
