REQUEST FOR ADDITIONAL INFORMATION REGARDING GLOBAL LASER ENRICHMENT COMPLIANCE PLAN FOR TITLE 32 OF THE CODE OF FEDERAL REGULATIONS PART117 (ENTERPRISE PROJECT IDENTIFIER L-2021-SPR-0002)
Dear Patricia Jenny:
The U.S. Nuclear Regulatory Commission (NRC) staff has reviewed your letter dated April 8, 2022 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML22102A018) and latest revision to your Compliance Plan submitted June 27, 2022 (ML22187A088). The Compliance Plan describes Global Laser Enrichments, LLC (GLE) plans for coming into compliance with Title 32 of the Code of Federal Regulations Part 117, National Industrial Security Program Operating Manual (NISPOM). GLEs Compliance Plan was submitted in response to NRC correspondence dated March 10, 2022 (ML22054A220).
Our review of the GLE Compliance Plan identified that additional information is needed before a final decision can be made on its approval. The additional information, outlined in the enclosure, should be provided to the NRC within 30 days from the date of this letter.
The NRC previously granted GLE enforcement discretion until September 6, 2022 to come into compliance with 32 CFR 117. Because GLE is taking reasonable and appropriate steps to come into compliance with 32 CFR 117 requirements, the staff will continue to exercise enforcement discretion pending formal NRC approval of GLEs Compliance Plan, no later than November 30, 2022.
Pending your response to our request for additional information, we anticipate completing our review of GLEs Compliance Plan by the end of September 2022. This date could change depending on the findings of our technical review, urgent assignments, or other factors. We will promptly communicate any significant changes to this schedule.
