Regional Office Notice No._1104. Rev. 1 CONFIDENTIALITY I A.

Purpose:

To advise of the Commission's policy statement on confidentiality.

B. Discussion:

The Commission has issued its policy statement on confidentiality effective November 25, 1985. The Regional Administrator, consistent with the Policy Statement, is empowered to grant confidentiality. The redelegation of authority to grant confidentiality is under consideration and will be addressed by the Regional Administrator.in the future. A revised regional policy guide will be icsued upon receipt of the manual chapter providing guidance for detailed implementation of the policy statement.

The identity of a confidential source will be divulged within the NRC only to those with a need-to-know. The confidential source identity will be divulged outside the NRC only under those circumstances outlined within the policy statement. Specifically, the Regional Administrator is empowered to provide the identity of a confidential source to a federal or state agency if the source does not object. The authority.to revoke confidentiality, including an oral grant of confidentiality, is vested exclusively with the Directors of 01, CIA, and the EDO and this authority may not be further delegated. Disciplinary action, in accordance with existing policies, will be initiated for the unauthorized disclosure of j the identity of a confidential source.

Copies of the Connission's Policy Statement have been provided to Region IV branch and section chiefs.
