June 18, 1986 CHRON0 LOGY OF MEETINGS AND SIGNIFICANT EVENil DJRING THE PROCESSING OF THE 0! FERMI INVESTIGATiti ;EPORT Date Event 09/04/85 OI:RIII Investigative Staff :riefed OI:HQ regarding the status of the Fermi investigatico. At this time, the investigation had ostensibly teen completed and 01 antic-ipated very little additional field investigation. 09/05/85 OI: Rill Investigative Staff b-iefed the former Executive Director for Operations, W. J. Dircks, and Senior NRC Staff members from Rill, NRR, OELD, 01: HQ and possibly OIE Staff. During this meeting, CI:RIII presented the results of the investigation which ha: been conducted to date. The EDO and Staff had been ap:rised that the investigation was virtually complete, however, the OI report of investi-gation had not yet been prepared. The facts and evidence concerning what was believed to have occurred was dis-cussed but 01: RIII advised that there should not be an attempt to draw conclusions urti; the report had been assembled and all of the inforr.a-ion had been checked and verified. As a result of the resting it was determined that there was a potential vitiation of $186 of the Atomic Energy Act. It was also conf mred that senior agency officials involved in the licensing decision for the Fermi 2 Operating License would not 9ase recommended for licens-ing of the Fermi facility on July 10, 1985. 09/06/85 OELD sent an attorney to RIII to review all 01 investigative material which fad been assembled during the OI investigation. 09/09/85 Communications between 01: RII: and 01:HQ resulted in a i decision to conduct three addi:icnal interviews of NRC officials in order to complete the Fermi investigation. 09/11/85 01:HQ RIII Operations Officer interviewed the Deputy Director, NRR (former Director, Licensing, NRR) concerning his involvement in the Fermi licensing process. As a result, it was confirmed that this official would have not recommended an operating lice *se for Fermi at the time of licensing had he known all the ir4 formation concerning the operator error. l 09/12/85 Commission Meeting Re: Fe rri i 10/17/85 Meeting between OELD, NRR and 2I. Enact nature of discussion cannot be recalled. 11/18/85 First review of Fermi Report of ;r.estigation at 01:HQ complete. 11/26/85 01:HQ Operations Of ficer and 01:EIII Investigator complete rewrite of specific report secti:ns. 12/02/85 Meeting between Director. 01, ECC and RIII Regional Administrator concerning potential follow-ups for the Fermi investigation. 12/11/85 Commission Meeting re: Fe rmi 12/12/85 Second review of the Fermi Report of Investigation complete. 01/07/86 Commission Meeting re: Fermi 01/27/86 Cancelled Commission Meeting re: Fe rmi 02/10/86 Meeting between EDO, V. Stello, :irector. 01, RIII Regional Administrator and Other Senior NRC Staff concern-ing the status of the 0! report :f investigation and 01's conclusions regarding the evider:e. The Staff, according to the EDO, needed the informati:n in the OI report to resolve unaddressed safety issues. Specifically, the character of certain individuals ir. the licensee's orga-nization was still being questic ec. The EDO directed ELD to prepare a letter to 01 reques: irs a draft report of investigation for the purpose of reviewing it for unre-solved safety issues. During this meeting, the parties were advised that all of the information which was con-tained in the 01 report had beer made available on num-erous occasions to members of the Staff. It was also explained that the only information which had not been provided was 01's conclusion regarcing the evidence. The Staff was advised, however, of 0:'s tentative conclusion which in fact was the final conclusion contained in the report. 02/12/86 Memorandum from EDO to Director, OI requesting a copy of the draf t O! report of investiga: ice on Fermi. The meme-randum indicated that the report caf contain information not known to the Staff and poter:ial unresolved safety issues. NOTE: This memorandum did rc: reflect what was discussed at the 2/10/8f meeting and, in fact, inferred that there was safety related information which had not beer provided for Staff review. This was ad essea in return correspondence dated 02/21/Ed. 2 l
1 Ju e 18.1986 02/21/86 Memorandum from Director, OI to EDO responding to the D2/12/86 correspondence. 01 provided a comprehensive response to the EDO in order to correct misconceptions and inaccurate characterizations concerning the history of the 01/ Staff communications and meetings concerning the Fermi investigation. 01 also reiterated the Commission policy regarding the processing and distribution of 01 reports. 03/11/86 Memorandum from EDO to Commission:
Subject:
Staff Dilenna Regarding Detroit Edison Conpany. The subject memorandum requested a Commission Meeting to resolve the issue of whether the Staf f had to accept the conclusions in the 01 reports of investigation "without question." 03/ /86 Commission Meeting re: Fe rmi . Attended by RIII, Regional Administrator, EDO, Director. 01, OELD, 0IE, and NRC Staff. 01 advised the Commission that the conclusions reached in the instant investigation indicated that the actions taken by certain Detroit Edison Company managers were done both knowingly and willfully and not by acci-dent. OELD, however, advised the Commission that their 1 conclusions were that the actions were "less than willful" ; and that. they had compiled an approximate 30 page analysis en the subject. 03/19/86 Memorandum from J. Lieberman, Director and Chief Counsel,
;egional Operations and Enforcement Division, OELD, for E DO. This memorandum contained a review of the 01 report of investigation concerning Fermi. The review concluded that the evidence in the 01 Fermi Report was not suffi-cient to find that there were material false statements nade by DECO managers and that the information did not support that information was " knowingly withheld."
04/09/86 Feeting re: Fermi with RIII. Attending the meeting were the Regional Administrator, 01 Field Office Director, Director. 01 and the 01: RIII Operations Officer. During the meeting, discussions were held concerning the 03/19/86 memo described supra and the potential ramifications. There was also a discussion of the O! report of investi- ' gation and the fact that the conclusior.s would remain the same. 05/21/86 Feeting between Director, 01 and the Commissioners' Legal Assistants re: Fermi. 05/86 %;merous discussions and corresponded.ce between 01 and Office of General Counsel (0GC) regarding the referral of the O! report of investigation to the Department of Jus-
