RESPONSE TO REPRESENTATIVE DINGELL'S LETTER REQUESTING AN INVESTIGATION 0F PREMATURE CRITICALITY AT FERMI on 7/2/85 On Septenber 20, 1985, the Office of Inspector and Auditor (OIA) received a Collegial Comission Correspondence Response Sheet (CR-85 ' <) regarding a proposed response to the Honerable John D. Dinge11's letter of August 23, 1985, on the captioned subject matter.

Our review of the proposed response indicates there is no mention of the fact that the actions of the Region III NRC employees involved in this matter are also being investigated. We note that although the Honorable John D.

Dinge11's August 23, 1985, letter does not specifically request an OIA investigation, the August 1,1985, letter to him from Richard E. Petticrew, Chairman, Monroe County Board of Conriissioners, takes issue with the actions of the "...NRC Representative on site at the Plant...".

Therefore, OIA suggests the proposed response from Chairman Palladino to Congressman Dingell incorporates the language below as a fifth paragraph in the letter:

In addition to the investigation of the licensee's actions in this matter, an investigation of NRC staff actions relative to this event is being conducted by our Office of Inspector and Auditor, cc: Comission (5)
