APPENDIX A NOTICE OF VIOLATION
' Texas A&M University Docket: 50-128/87-01 Nuclear Science Center License: R-83 During an NRC inspection conducted on January 12-14, 1987, violations of NRC requirements were identified. The violations ~ involved: (1) the failure to perform a proper evaluation of experiments before irradiation in the reactor, and (2) failure to fully implement the Emergency Plan. In accordance with the
" General Statement of Policy-and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1986), the violations are listed below:
- 1. Failure To Evaluate Reactor Experiment Facility Operating License Technical Specification 3.6.3 requires, in part, that "(a) Experiment materials . . . which could off gas, sublime, volatilize, or produce aerosols under (1) normal operating conditions of the experiment or reactor . . . shall be limited in activity such that if 100% of the gaseous activity or radioactive aerosols produced escaped to the reactor room or the atmosphere, the airborne concentration of radioactivity averaged over a year would not exceed the limit of Appendix B of 10 CFR Part 20."
Contrary to the above, the NRC inspector determined on January 14, 1987, that the licensee failed to perform appropriate evaluations of the hazards involved with the irradiation and subsequent handling of a bromine experiment conducted on or about December 18, 1986.
This is a Severity Level IV violation. (Supplement I) (128/8701-01)
- 2. Failure to Implement the Emergency Plan 10 CFR Part 50.54(q) requires, in part, that licensees authorized to
_ possess and operate a research reactor shall follow and maintain in effect emergency plans which meet the requirements of Appendix E to 10 CFR Part 50.
Paragraph 3.1 of the NRC approved Emergency Preparedness Plan for the Nuclear Science Center (NSC) at Texas A&M University, dated November 1982, l requires that written agreements with offsite organizations for augmentation of NSC emergency organization be renewed on an annual basis, l and be included in Appendix A to the Plan.
Contrary to the above, the NRC inspector determined on January 13, 1987, that the letter of agreement between the NSC and St. Joseph's Hospital in Bryan, Texas, had expired on December 31, 1986, and had not been renewed.

Where good cause is shown, consideration will be given to extending the response time.
