Texas A&M University Operating License:

R-83 During an NRC inspection conducted on February 21-23, 1990, a violation of NRC.

L requirements was identified. The violation involved the failure to verify that a recipient of byproduct material was properly licensed to receive such material.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1989) (Enforcement-l Policy), the violation is listed below:

l Verification of Valid Byproduct Material License 10 CFR 30.41(c) requires that before transferring byproduct material to a licensee, the licensee transferring.the material shall verify that the I

transferee's license authorizes the receipt of the material.

10 CFR 30.41(d) lists the methods of verification which may.be used by the transferor.

Contrary to the above, on February 23, 1990, the inspector identified that the licensee transferred 80 mil 11 curies of radioactive sodium (Na-24) to a company in October 1989 without verifying that the company was authorized-to possess the transferred material.

This is a Severity Level V violation.

(1) the reason for the violation if admitted, (2) the corrective steps which have been taken and the results achieved, (3) the corrective steps which will be taken to avoid further.
