July 17, 1986 EN 86-57 OFFICE OF INSPECTION AND ENFORCEMENT NOTIFICATION OF SIGNIFICANT ENFORCEMENT ACTION Licensee: Texas A & M University, College Station, Texas Docket No. 50-128
Subject:
PROPOSED IMPOSITION OF CIVIL PENALTY - $1,250 This is to inform the Comission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of One Thousand Two Hundred Fifty Dollars ($1,250) will be issued on or about July 22, 1986 to Texas A & M University. This action involves a May 1, 1986 power excursion and resultant over-power trip caused by the removal of an experiment with a reactivity worth of $1.08 from the reactor while it was operating. Technical specifications state that the reactivity worth of an experiment shall be estimated or measured before operating the reactor with the experiment installed. Also, non-secured experiments are required to have a reactivity worth of less than one dollar.
Neither of these requirements were satisfied by the licensee.
It should be noted that the licensee has not been specifically informed of the enforcement action. The Regional Administrator has been authorizea by the Director, Office of Inspection and Enforcement, to sign this action. The schedule of issuance and notification is:

The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
