Attached is a copy of the response Kerr-McGee made on April 8, 1975 to the items of noncompliance as stated in our enforcement letter dated March 19, 1975, copy of which was previously furnished you.

We have no problems with terr-McGee's corrective actions taken on the one infraction or on deficiencies No. 1,2,4,5 and 6. Regarding deficiency No. 3, the Kerr-McGee Transportation Security Plan dated February 22, 1974, in Section 5.5.7, Paragraph 2, commits to the following: "At least once each six months during a shipment, (representatives of Kerr-McGee) will intercept a shipment at a planned stop and examine the drivers procedures record during

< such a planned stop. A record of the observations will be completed upon return and circulated with a quarterly audit conducted in Joplin."

We have interpreted this commitment as requiring a Kerr-McGee representative to intercept an in-transit shipment at a planned stop during the course of the shipment, not at origin or destination. The key words in Section 5.5.7, in our judgment, are "during a shipment," " intercept" and "upon return" which indicate the interception is made on the route of travel and that a report is to be initiated by the Kerr-McGee representative upon his return to the.

Kerr-McGee facility. It is Kerr-McGee's interpretation that they meet their security plan commitment by performing their records review of shipments when the shipment is at the Cimarron (Crescent) facility, the point of departure on the outbound leg, the point of delivery on the inbound leg.
