Dear. Dr. Meyers:
Thank you for your letter of February 9,1984 expressing an interest in obtaining the most recently released version of the Transient Reactor Analysis Code (TRAC-PF1/M001).
The U.S. Nuclear Regulatory Commission (NRC) will be happy to transmit to you a magnetic tape containing the code and a copy of the draf t user's manual provided that General Electric Company (GE) agrees to the following.
1.
GE will not release the code software to any third party.
2.
GE will immediately notify the NRC of any reactor safety problem which may be uncovered through the use of the code.
3.
If GE discovers code errors, GE will communicate these errors to the code developers (Los Alamos National Laboratory (LANL)).
4.
GE will make the results of the code use available to the NRC.
5.
If GE makes any improvement and/or modification to the code, these improvements or modifications will be made available to the NRC.
Should code improvements and modifications, or the results of code use, be determined to be company proprietary, the NRC will utilize its procedures to protect such information.
6.
If GE requires LANL assistance to implement and/or use this software, the assistance will be given on a cost recovery basis and will be j
negotiated in a separate agreement with the NRC.

In interpreting the results of your analyses under Items 2 and 4 above, bear in mind that the TRAC-PF1/ MODI code has undergone developmental assessment, but the independent assessment of the code has not yet been completed. We do not warrant the accuracy of the results for any particular use or application.
The signature below of an appropriate official of your company will indicate acceptance of these items.
