Dear Mr. Prelewicz:

Thank you for your letter of June 1.1984 expressing an interest in obtaining the IRT computer program. The U.S. Nuclear Regulatory Consission (NRC) will be happy to transmit to you a magnetic tape containing the code provided that ENSA. Incorporated (ENSA) agrees to the following.

1. ENSA will not release the code software to any third party.

2. ENSA will immeditt4}ynotify the NRC of any reactor safety problem which may be uncovered throggh the use of the code.

3. If ENSA discovers code errors. ENSA will communicate these errors to the code developers at the Brookhaven National Laboratory (BNL).

4. ENSA will make the results of the code use available to the NRC.

5. If ENSA makes any improvement and/or modification to the code.

these improvements or modifications will be made available to l the NRC. Should code improvements and modifications or the

results of code use, be determined to be company proprietary.

the NRC will utilize its procedure to protect such information.

6. If ENSA requires BNL's assistance to implar.ent and/or use this software. the assistance will be given on a cost recovery basis and will be negotiated in a seperate agreement with the NRC.

In interpreting the results of your analyses under Item 2 and 4 above, bear in mind that the NRC does not warrant the accuracy of the results for l any particular use or application.
