Centlemen:

This refers to the inspection conducted by Messrs. T. J. Madeda

and J. J. Dunleavy of this office on January 10-12, 1978, of activ-

ities at the Dow TRIGA Research Reactor Facility authorized by NRC

1.icense No. R-108 and to the discussion of our findings with

Mr. R. Westover and other cembers of the Dow Chemical Company staff

at the conclusion of the inspection. The inspection findings were

also the subject of our letter dated January 13, 1978. A separate

-

manage =ent meeting between C. E. Norelius, J. F. Donahue and

J. J. Dunleavy of this of fice and G. Kochanny, and re=bers of the

Dow staff was held at the Dow Chemical Research Reactor Tacility

on February 7,1978, to further discuss our findings. Our draft

inspection report was referred to our Headquarters with the recom-

mendation that serious consideration be given to escalated

enforce =ent action. Based upon the safety considerations involved

and the timely action taken by Dow to correct the items of noncom-

pliance, it was decided, however, thzt a Notice of Violation issued

by this of fice is appropriate in this instance.

The enclosed copy of our inspection report identifies areas

. examined during the inspection. Within these areas, the

inspection consisted of a selective examination of procedures

and representative records, observations, and interviews with

personnel.

During this inspection, certain of your activities appeared

to be in nonco=pliance with NRC requirements, as described

in the enclosed Appendix A.

This notice is sent to you pursuant to the provisions of Section

2.201 of the NRC's " Rules of Practice," Part 2, Titic 10 Code

of Federal Regulations. Section 2.201 requires you to submit to

this office within twenty days of your receipt of this notice a

written statement or explanation in reply, including for each

itec of noncompliance: (1) corrective action taken and the results

achieved; (2) corrective action to be taken to avoid further non-

compliance; and (3) the date when full compliance will be achieved.

Areas emined during this inspection concern a subject matter which

is esempt from disclosure according to Section 2.790 of the NRC's

" Rules of Practice," Part 2, Title 10, Code of Federal Regulations.

Consequently, the enclosure to this letter, our report of this inspec-

tion, and your response to the noncompliance identified in the enclosure

to this letter will not be placed in the Public Document Room. There-

fore, your state:nent of corrective action regarding the noncompliance

identified in the enclosure should be subcitted as a separate enclosure

to your transmittal letter.

We will gladly discuss any questions you have concerning this

inspection.
