This refers to your letter dated February 24, 1976, informing us of the steps you have taken to correct the noncompliance identified in our letter dated February 10, 1976.

Our conments to your reply are contained in the enclosure to this letter. The enclosure concerns a subject natter which is exempt from disclosure according to Section 2.790(d) of the NRC's " Rules of Practice," Part 2 Title 10, Code of Federal j Regulations, and consequently, will not be placed in the Public Docunent Room.

  • Dow Chemical Company License No. R-108 Items No. I and 2 - At the time of the inspection, certain of your acti-vities were in noncompliance 91th the Security Plan requirements relative toI Subsequent to the inspection, you have submitted changes to reficct actual security practices at the site. These changes, if approved by ONRR, will be considered as correc-tive steps taken to avoid further items of noncompliance. Until there is an ONRR decision concerning your submittal, you are reminded that the presently approved Security Plan requirements are obligatory.

In regards to your comments relating to our concerns about the we still feel that the capability to detect unauthorized access toequipmentdefinedinyourSecurityPlanas[~ I] is necessary. As indicated in our letter of February 10, 1976, our comments concerning this matter were referred to NRC Headquarters for consideration.

E* Mi d) it:: N:== tion REPLY TO NOTICE -Or VIOLATION Item 1_ - Changes in the radio communications equipment used y the Midland County Sheriff's Dept. last year made it incom-atible with equipment in use at The Dow Chemical Midland Plant, This eliminated the immediate availability of radip communi-cation between the Sheriff's Dept. and the plant. Detailedlet evaluation between Plant Se'curity and the Sheriff's Dept.backed it appear that the direct-line teJephone communication, up by messenger communication to the Sheriff's Dept., located -

less than one mile from the Dow plant, constituted adequate In case of means of communications for forseeable emergencies.

emergency and failure of the telephone communication, a member of the Sheriff's Dept. can be at the plant within minutes with a police cruiser containing radio communication equipment compatible with that used at the Sheriff's Dept. The item has been changed in the enclosed Security Plan.
