TYP0 GRAPHICAL ERROR NOTICE OF VIOLATION (EA 95-220) During an audit of the Inspection Follow Up System (IFS) database for Browns Ferry Nuclear Plant, an error was identified on the Notice of Violation (NOV) issued by Enforcement Action 95 220. The NOV references an incorrect docket and license number. This is considered a typograpnical error. The purpose of this memo is to document the identified error in the docket files. The Docket and License Numbers as listed on the NOV are: Docket Nos. 50-259. 50 260 and 50-425 License Nos. DPR-33. DPR 58, and DPR-6B The correct Docket and License Numbers associated with this enforcement action item are: Docket Nos. 50 259. 50-260, and 50-296 License Nos. DPR-33. DPR 52 and DPR 68 Docket No. 50 425 (Vogtle Unit 2) and License No. DPR-58 (D.C. Cook Unit 1) were not involved with or associated with the enforcement action.

As a result of review of a Secretary of Labor Decision and Order dated t% August 22, 1995 (93-ERA-044), a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," NUREG-1600s the violation is listed below: 10 CFR 50.7 prohibits discrimination by a Commission licensee or a contractor or subcontractor of a Commis'sion licensee against an employee for engaging in certain protected activities. Discrimination includes discharge or other actions relating to the compensation, terms, conditions, and privileges of employment. The activities which are protected include, but are not limited to, reporting of safety concerns 9 by an employee to his employer. Contrary to the above, on February 2 and 4, 1993, the licensee failed to ensure that the provisions of 10 CFR 50.7 were implemented in that Stone 

                     & Webster Engineering Corporation, a contractor to the Tennessee Valley Authority at the Browns Ferry Nuclear Plant, discriminated against Mr. Douglas Harrison for engaging in protacted activities.

l Specifically, as determined by the Secretary of Labor, Stone & Webster j ingineering Corporation demoted Mr. Harrison and transferred him to a different position because he raised concerns related to firewatch ruuirements. (01012) This is a Severity Level-II violation (Supplement VII). Civil Penalty - 580,000. The NRC has conc;uded that information regarding the reason for the violation,  ; the corrective actions taken and planned to correct the violation and prevent i i recurrence and the date when full compliance-will be achieved has already been  ! adequately addressed. However, Tennessee Valley Actbority (Licensee) is l required to submit a written statement or explanction pursuant to 10 CFR 2,201 within 30 days of the date of this Notice of Violation and Proposed Imposition l of Civil Penalty if the statements made during the predecisional enforcement conference concerning these matters do not accurately reflect its corrective actions or its position. Within the same time as provideri for the response ' noted above, the Licensee may pay the civil penalty by letter addressed to the > Director, Office of Enforcement, U.S. Nuclear Regulatory Commission, with a check, draft, money order, or electronic transfer payable to the Treasurer of the United States in the amount of the civil penalty proposed above, or the cumulative amount of the civil penalties if more than one civil penalty is proposed, or may protest imposition. of the civil penalty in whole or in part,  ; by a written answer addressed to the Director, Office of Enforcement, U.S. Nuclear Regulatory Commission. Should the Licensee fail to answer within the time specified, an order imposing the c:vil penalty will be issued. Should the Licensee elect to file an answer in accordance with 10 CFR 2.205 l protesting the civil penalty, in wholc or in part, such answer should be clearly marked as an " Answer to a Notice of Violation" and may: (1) deny the Attachment Och / / [-
