BYRON 1 OPERATING LICENSE REVIEW COSTS LFMS R/F LFMS Reactor File '

DW/CJH/ Files-Byron 10 CFR 170 of the Comission's regulations for license fees was revised Ch (2a effective June 20, 1984. Section 170.12(b) of the revised rule provides il that for applications for operating license (0L) review which have been pending with the Comission for six months or longer, billings would be made at six-month intervals until the review is completed, whichever is earlier.

In accordance with Section 170.12(b), we have reviewed the cost incurred

', by the various program offices directly involved in processing the operating license for the period June 24, 1984 through December 22, 1984. Attached is a sumary of the review costs as well as the

supporting documentation from the program offices. The attachment shows that a total of $702,593 was expended from June 24, 1984 through December 22, 1984 for the OL review. Cost adjustments totaling $14,942 were made by NRR (see memo Lars Solander to W. O. Miller dated October 22, 1985 and my memo to files dated November 22,1985) from the previous billing period, leaving net costs for this period of $717,535.

When the costs of $717,535 are added to the costs of $2,757,405 from the previous billing period, the cumulative costs through December 22, 1984 j are $3,474,940. This total exceeds by $397,540 the maximum fee of

$3,077,400 as stated in 10 CFR 170.21. Accordingly,$397,540 has been i subtracted from the costs of $717,535, leaving a balance due of

$319,995. ,

accordance with Footnote 2 of 10 CFR 170.21, only $319,995 may be assessed for the issuance of the operating license.
