RESPONSE TO TVA's LETTER DATED APRIL 3,1998 REGARDING IMPLEMENTATION OF THE MAINTENANCE RULE AT BROWNS FERRY, UNIT 1 l

From April 4-8,1997, the NRC conducted an inspection of implementation of1(bCFR 50.65 (the ' l Maintenance Rule) at the Browns Ferry Nuclear (BFN) Plant. The results of the Jnspection are documented in NRC Inspection Report 50-259/97-04,50-260/97-04, and 50-227/97-04 (IR 97-04) l issued May 21,1997. IR 97-04 concluded that TVA's actions to implement the Maintenance Rule for BFN Unit 1 were technically adequate to support the interface functions with BFN Units 2 and 3, and the BFN Unit 1 systems required to maintain spent fuel pool cooling. However, an .

Unresolved item (URI 50-259/97-04-01) was identified for Unit 1 conceming TVA's approach to l compliance with the Maintenance Rule for structures, systems and components required to be 1 within the scope of the rule, but not required for Unit 1's current shutdown state. Region 11 l forwarded Task interface Agreement (TIA) 97-15, dated June 4,1997, to NRR requesting  !

resolution of URI 50-259/97-04-01. NRR subse ently reviewed the issue, and requested ~

I additional information from and met with TVA BFN Unit 1 was shut down in 1985, and has remained shut down. By letter dated July 10,1991, TVA provided a " Regulatory Framework for Restart of Units 1 and 3," which reiterated TVA's commitment to not restart Unit 1 without prior NRC approval. In addition, TVA committed, by letter dated April 16,1996, to request approval from the NRC prior to restart of Unit 1. By letter dated April 5,1998, the Union of Concemed Scientist (UCS) submitted a petition pursuant to 10 CFR 2.206 requesting that the Operating License for BFN Unit 1 be revoked since BFN Unit 1 has been on " administrative hold" since 1985.
