,The following chronology should help refresh your memories and/or prepare you  !

for the. meeting. ,

l The NRC conducted an inspection of the implementation of 10 CFR 50.65 at l s CFN1 (April 4 through 18, 1997). The results are documented in Inspection Report 50-259/97-04 (May 21, 1997).

The inspection team found that TVA had scoped SSCs for Unit i under the rule considering plant status (i.e., shutdown and defueled). Unit i systems supporting Unit 2 or Unit 3, common systems, and systems needed to maintain safe shutdown of Unit 1 were properly scoped. h other systems usually in the scope for an operating plant were not included in the scope, and performance monitoring, data collection, and trending were not being performed because the systems were not in use or were

( in layup.

1 The inspection team concluded that TVA's actions to implement the rule at Unit 1 are technically adequate, however, the inspectors raised the question as to whether the approach taken is legal under the maintenance rule (URI 50-290/97-04-01).

Region II issued TIA 97-015 (June 4, 1997) requesting assistance ... to develop a list of actions necessary for TVA to comply legally with the Rule on  !

Unit 1. Region requested the list of actions be provided directly to TVA.

I NRR letterd o TVA July 30, 1997, states 'that the paragraph (a) (1) l limitation for plants that are permanently shutdown does not apply to BFN1. l Thus, full compliance is required. The letter indicated that three options l

l are available:

l Revise the scope of the monitoring program for Unit 1 {

l Submit certification of permanent shutdown per 50.82 (a) (1) l Submit a request for an exemption.

i-j The letter requested that TVA indicate which action it believes is j l

applicable, or discuss how another proposed option is consistent with the

, regulations.

  • TVA responded by letter (September 29, 1997) stating its contention that .

the Unit 1 program is in compliance.with the rule and presented its reasons ]

for this belief. /
