Dear Mr. Chilk:

Florida Power and Light Company (FPL) has received, and herein submits its views / comments on the Referencea Advance Notice:

FPL owns and operates four commercial nuclear units in South Florida. FPL is actively involved in the procurement of nuclear fuel to be utilized in those nuclear 'Inits. A major component of the cost for this nuclear fuel services. Accordingly, FPL andison associated with enrichment behalf of its ratepayers, is interested in any licensing regulations that would govern the construction and operation of uranium enrichment facilities.

FPL recognizes that applicable Regulations already exist under Title 10. Code of Federal Regulations, Part 50 for the licensing of (production and utilization) enrichment facilities. The NRC hos licensed uranium conversion and fabrication facilities.

Therefore, rulemaking is not necessary for the NRC to receive, review, license. and act upon a p pTTi: a t i o n for en enrichment facility FPL believes that it is best that the NRC work closely with an applicant and draw on experience in licensiqg u r a n i um . c,q o gr s,1,g n and fabrication facilities to develop g u id e l i n e s t o 1;ic,ep# an enrichment facility on the basis of the current r eg u l a t io n s in 10CFR Part 50. This process would also benefit from the establishment of a licensing review basis in advance of any licensing submittal that would set forth criteria to be used in the review process. FPL believes that such a licensi)g experience would be very valuable in establishing rulemakipg regulation, should it be necessary in the future.
