SUBJECT:

CONGRESSIONAL CALLS RE SAN ONOFRE UNIT 1 At approximately 4:08PM on October 4, 1984, I received a call from a Congressman Packard of California. He was calling with respect to San Onofre Unit 1.

He suggested that the NRC resolve the problem of whether or not an amendment is involved so that undue delay or cost does not result.

He said that the energy from this plant is needed. He also would' like to keep nuclear power as a viable source of energy and indicated that a Commission' decision could result in severe setback.

I told the Congressman that I had met with Mr. Allen and several of his colleagues regarding San Onofre; that they had presented a legal opinion based on the way they see the situation; and that I had asked our General Counsel for his view on whether an amendment or no amendment was in order. I said that I would like to have the results of the OGC analy. sis- before going ahead. I told the Congressman that we were not being arbitrary or capricious and that we were being very careful to make sure we are on solid ground whatever direction we take.

- I concluded by telling him that I had an informative talk with Allen and the others and -thanking him for his call.

Also, enclosed for your information is a memorandum for file related to a call received in my office from Congressman Badham on the subject of San Onofre Unit 1.
