TELECON - CONGRESSMAN RON PACKARD l 1 '

About 11:00 a.m. this morning while I was in a Commission meeting I was handed a note by my secretary indicating that Congressman Ron Packard of Califorania urgently wanted to speak

to me (he had to leave his office before 11
30 a.m.). I stepped out of the meeting to return Congressman Packard's call. The substance of the conversation was as follows:

i Congressman Packard was calling about San Onofre, Unit 1. He indicated to me that, as he believed I knew, the California PUC

was requiring that San Onofre, Unit 1, be operating by the end of the year if it is to remain in the rate base. The Southern jl California Edison people, who are in town, indicated to *l i

Congressman Packard that it did not appear that Unit I could be -

operating by that time in view of unexpected NRC requirements.

j. He further said that they tried to talk to someone at NRC about this matter yesterday and were told that this could not be done because this was a matter coming before the Commission.*

Congressman Packard said that he learned later that our OGC saw I no problem with speaking to the Commission on this subject. He expres' sed an interest in t.be Commission or a representative of the Commission trying to meet.with these people today. When I told him that, in view of our tight schedule, there was no 4

i possibility of speaking to them today, Congressman Packard said

, that talking to them tomorrow or at a future time would be appropriate. I also told Congressman Packard that I did not see

much value in talking only to a representative of the Commission i inasmuen as the Commiss-ion acts as a whole.

In this connection, the Southern California Edison people may be referring to a statement I made during the courtesy call they cade on me yesterday with the agreement that no substantive item would be discussed. Nevertheless, during the meeting they made reference to their desire to get San fj Onofre, Unit 1, running by the end of the year. To avoid getting into a substantive matter, I indicated that I didn't think it was appropriate to discuss that issue inasmuch as it was coming before the Commission for action.

I then asked Congressman Packard what specifically was he requesting. His request was that either the Commission or a representative of the Commission speak to the Southern California Edison people on this issue as soon as such a meeting could be scheduled. I told him that I would bring his request to the Commission's attention and inform him of the results. I did indicate to Congressman Packard that we were having an Agenda Planning Session later this afternoon at which time I might be able to consult with my fellow Commissioners.

Following the completion of the Commission meeting this morning, I called Herzel Plaine and suggested that he call Congressman Packard and indicate to him that we do not have a formal request from Southern California Edison to meet with the Commission and to inform the Congressman that, if the Southern California ,

Edison people wish to submit such a request in writing, it would be helpful if we received it before our Agenda Planning Session scheduled for 4:30 p.m. today. l Herzel Plaine indicated that he would make the call and inform me of the results.
