1. This license applies to the Monticello Nuclear Generating Plant, Unit No.1, a single cycle, forced circulation, boil-ing water reactor and electric generating equipment (the facility). The facility is located in Wright County on the Northern States' site in Wright and Sherburne Counties, Minnesota, and is descr. bed in the " Final Safety Analysis Report," as supplemented and amended (Amendment Nos. 9 through 28).
2. Subj ec t to the conditions and requirements incorporated herein, the Commission hereby licenses Northern States:

A, Pursuant to Section 104b of the Atomic Energy Act of 1954, as amended (the Act), and 10 CFP Part 50,

" Licensing of Production and Utilization Facilities ,"

to possess, use, and operate the f acili ty as a utilization facility at the designated location'at the Monticello Nuclear Generating Plant; i

B. Pursuant to the Act and 10 CFR Part 70, "Special Nuclear Material, to receive, possess, and use at any one tine up to 2300 kilograms uranium 235 as reactor

~ fuel assemblies, one gram of uranium 235 as fission chambers and 16 erams of plutonium as contained in Pu-lie neutron sources in connection with operation of the facility; 4

C. Pursuant to the Act and 10 CFR Part 30, " Rules of General Applicability to Licensing of Byproduct Material,' to receive, possess, and use in connection with operation of the facility: ten sources of Antimony 12',, not to exceed 1,250 curies per source; E

u. one source of Americium 241, not to exceed 7 curies; four sources of Cobalt 60, two not to exceed 350 microcuries per source, one not to exceed 500 mil 11 curies and one not to exceed 12.5 mil 11 curies; Strontium 90, net to exceed 1.2 microcuries per source; Cesium 137 not to exceed 8 microcuries j per source (all as sealed sources); Americium 241, Cesium 137 and Strontium 90 each not to exceed 1 millicurie per nuclide, and Cobalt 60 not to 4 exceed 27 microcuries (all without restriction as to chemical or physical form); and 2.702 milli-curies of Cesium 137, and 0.5405 mil 11 curie of Cobalt 60 (in solution form); and

possess, but not separate, such byproduct and spe-cial nuclear material as may be produced by the operation of the facility.

3. This license shall be deemed to contain and is subject to-the conditions specified in the following Commission regulations:

10 CFR Part 20, Section 30.34 of 10 CFR Part 30, Section 40.41 of 10 CFR Part 40, Sections 50.54 and 50.59 of 10 CFR Part 50, and Section 70.32 of 10 CFR Part 70; and is subject to all i

applicable provisions of the Act and to the rules, regulations, and orders of the Commission, now or hereaf ter in ef fect; and is subject to the additional conditions specified below:

i A. Maximum Power Level; Reactor Vessel Head Not In Place Northern States is authorized to load fuel and onerate the facility at power levels not in excess of five (5) megawatts (thermal), without the reactor vessel head

in place.

B. Technical Specifications l The Technical Specifications contained in Appendix A l -attached hereto are hereby incorporated in this license. Northern States shall operate the facility l at power levels not in excess of five (5) megawatts

, C. Reports Northern _ States shall make certain reports in accordance with the requirements of the Technical Specifications.

D. Records 1

Northern States shall keep facility operating records in accordance with the requirements of the Technical Specifications.

4 i Northern States shall observe such standards and requirements

! for _the protection of the environment as are validly imposed pursuant to authority established under Federal and State law and as are determined by the Commission to be applicable to the facility covered by this provisional operating' license.

This condition does not apply to (a) radiological effects since such effects are dealt with in other provisions of this operating license, or (b) matters of water quality covered by Section 21(b) of the Federal Water Pollution-4 Control Act, as amended.

5.

This license is. cffective as of the date of issuance and shall expire eighteen (18) months from said date, unless extended for good cause shown, or upon the earlier issuance of a superseding operating license.
