SUBJECT:

TELEPHONE CALL WITH ARNIE WIGHT, AMFM PANEL, 9/24/A4 Mr. Wight called with regard to NRC authority over any substitute organization for DOE for the national high level waste program. He specifically inquired as to whether NRC would have authority to regulate an organization which might substitute or replace DOE as the organization to manage the HLW program. I told him that under its authority NRC normally regulates private concerns--the regulation of 00E for HLW is out of the ordinary.

I told Mr. Wight that if the AMFM Panel intends for NRC to regulate a substitute organization in essentially the same manner as NRC regulates DOE, that whatever action that brings the substitute organizatior, into being should specify that the regulatory relation of NRC with the substitute organization would continue as the relationship between NRC and DOE under the NWPA and applicable regulations, particularly Part 60.

I told Mr. Wight that regardless of the Panel's recommendation, if it departs from the existing situation, it would be of value to explicitly express the Panel's intent concerning regulation so there would be no misunderstanding of the NRC role intended by the Panel.

Mr. Wight then briefly discussed issue resolution concensus building on technical issues.
