Dear Dr. Copan:

By letter dated September 23, 2019 (Agencywide Documents Access and Management System

[ADAMS] Accession Number ML19269B774), you submitted to the U.S. Nuclear Regulatory Commission (NRC) the triennial update to the National Institute of Standards and Technology (NIST) Decommissioning Funding Plan (DFP), as required by Title 10 of the Code of Federal Regulations (10 CFR) Paragraphs 70.25(e)(2). The financial instrument used by NIST was a Statement of Intent (SOI), consistent with 10 CFR 70.25(e)(4) for a Federal Government licensee. The DFP update is to include a detailed decommissioning cost estimate (DCE) for meeting the criteria of the 10 CFR 20.1402 criteria for unrestricted use.

Following the initial review, a supplement was provided by a submittal on November 27, 2019 (ADAMS Accession No. ML19336A002). Following a request we made to you for additional information on February 4, 2020 (ADAMS Accession No. ML20030A659), you responded on February 28, 2020 (ADAMS Accession No. ML20065H161). The Financial Assessment Branch of the Division of Rulemaking, Environmental, and Financial Support in the Office of Nuclear Material Safety and Safeguards conducted the technical review of the adequacy of the submittal for SNM-362.

The NIST is required to submit a DCE to the NRC for review and approval as a part of the DFP update. The NRC staff concludes that the SOI satisfies the requirements of 10 CFR 30.35(e)(1) and 10 CFR 70.25(e)(1), is consistent with NUREG-1757, Vol. 3, Rev. 1, Consolidated Decommissioning Guidance: Financial Assurance, Recordkeeping, and Timeliness, February 2012 (ADAMS Accession No. ML12048A683), and is therefore acceptable. A technical evaluation report for the analysis of the materials license is enclosed.

In accordance with 10 CFR Section 2.390 of the NRCs Agency Rules of Practice and Procedure, a copy of this letter and the enclosure will be available electronically for public inspection in the NRC Public Document Room or from ADAMS.
