Discussion: On _ March 9, 1981, the Director of the Office of Inspection and Enforcement issued a confirmatory order to improve the licensee's performance at the Palisades plant. Pursuant to the opportunity i for a hearing offered by the order, the Utility Workers Union of America and the Michigan State Utility Workers Council filed the attached peti-tion requesting a hearing on the overtime condi-tions imposed by the order. I The licensee, by consenting to the order, has waived its right to a hearing. See 10 CFR 2.202(e). Thus there is currently no proceeding on this order. */ The NRC staff has filed a i response opposing a hearing on the basis that

A separate civil penalty action is being contested by the licensee in a civil penalty proceeding before Administrative Law Judge Ivan Smith. However, Judge Smith has indicated that he would not be available to rule upon this request should he be asked to do so.

AFL-CIO AND ITS MICHICAN STATE UTILITY WOPREES COU';CIL FOR HEARING ON ORDER CONFIPJ:ING LICENSEE ACTIONS TO UPGRAEE FACILITY PERFOP."J2:CE The Utility Workers Union of America, AFL-CIO, and its Michigan State Utility Workers Council (hereaf ter, "the Union") hereby request a hearing on the Order of this Commission dated March 9, 1981, captioned " Order C'nfirming Licensee o Actions to Upgrade Facility Performance," for the following reasons and grounds: I.- On March 9, 1981, the Commission issued an Order Confirming Licensee Actions to Upgrade Facility Performance. Part V, Sec. B thereof, provided that: " Extended overtime on the part of licensed operators shall be avoided by restricting the overtime for licensed operators as b-follows: D .3 (1) No more than 4 overtime hours in any 8 'Docym 24-hour period; E 'APR 71981 > I (2) No more than 24 overtime hours in p h. The Director of Region III may relax or terminate any of the preceding conditions in writing for gcod cause." ,= II. Said provisions restricting overtime were evidently proposed by the licensee, not this Commission, and
1 without notice or consultation with the Union, which is the k::: collective bargaining agent for operating, maintenance and construction empicyees of the licenses at the Palisades Facility and elsewhere in Michigan. III. The overtime restriction contained in said e order is more restrictive than this Commission's standards otherwise applicable, as set forth in the interim criteria for shift staffing, issued July 31, 1980, by the Commission, by Darrell G. Eisenhut, Director, Division of Licensing, as follows: " (1) An individual shall not be, permitted to work more than 12 hours straight (not including shift turnover time). (2) An individual shall not be permitted to work more than 24 hours in any 48 hour period. (3) An individual shall not work more than 72 hours in any 7 day period. (4 ) An individual shall not work more than 14 consecutive days without having two consecutive days off. However, recognizing that circumstances may arise requiring deviation from the above restrictions, such deviation may be authorized by the plant manager or higher levels of management in accordance with published procedures and with appro-priate documentation of the cause. " IV. On information and belief, no reason was demonstrated or existed or was pertinent to this Cormdssion's March 9, 1981 Order _to occasion greater restriction on i overtime that is otherwise required by the Commision's l' general standards, or is permitted to the licensee under its collective bargaining. obligations to the L'nion under the hational Labor Relations Act.
'V. Pursuant to 10 CFR 2, 714 (a) (2) and said i ( Me.rch 9, 1981 Order, the Union represents that, as aforesaid, it is the exclusive collective bargaining agent-by law for affected employees; and that the employment opportunities or its members are, or may be adversely affected by said Order. VI.- For the foregoing reasons, the Order should not be sustained insofar as it contains the aforesaid restric-tions on overtine hours. WHEPIFOPI, Petitioners pray that a hearing be held for reconsideration of such Order in the foregoing respects, and that such Order be vacated in the foregoing respects. i e II. A HEARING SHOULD NOT BE HELD EITHER AS A MATTER OF RIGHT OR AS A t1ATTER OF DISCRETION A. The Union Does Not Have Standing Such l That A Hearina Is Recuired Ey Law In enforcement cases, as in licensing cases, this Commission applies judicial concepts of standing in determining rights to a hearing under section 189a. of the Atomic Energy Act. Public Service Co. of Indiana (Marble Hill Nuclear Generating Station, Units 1 & 2), CLI-80-10, 11 NRC 438 (1980); Wisconsin Electric Power Co.,(Point Beach, Unit 1), CLI-80-38,12 NRC 547 (1980). In the context of an enforcement action i such as this Order, it rast appear (1) that the petitioner has been or may be injured in fact, i.e., adversely affected by the Director's Order, and (2) that the petitioner's affected interest is arguably within the zone of interests protected by the Atomic Energy Act. Id. at 439; see also Portland General Electric Co. (Pebble Springs Springs Nuclear Plant, Units 1 & 2), CLI-76-27, 4 NRC 610, 613 (1976). In this proceeding, the Union avers that it is the exclusive i collective bargaining agent by law for operating, maintenance and construction employees of the licensee at the Palisades facility and elsewhere in liichigan. Granting the Union's petition in this case would provide. however, just su:n a foru-to exa. ine the licensee's contractual relationship witn its enployees. In Callaway, despite the licensee's j contention that the GRC's actions constituted an unwarrantej intrusion into labor natters, the Appeal Board found that the i URC's responsibilities to exanine serious questions of public health and safety prevail over any possible adverse inpa:t on labor relations.
