Dear Mr. Martin l
The Union has become aware of certain information with direct bearing on the proposed adverse actions against Messrs. Caldwell and Kelly. Because we learned of the information subsequent to our information request dated April 14, 1989, the Union subnits the following supplemental request for necessary I
and relevant information. The request is made pursuant to 5 U.S.C.
67114(b)(4) and Article 45 section 45.6 of the Interim Collective Bargaining Agreement.
Please produce all requested materials to the following:

all materials in the possession oft he Office of General Counsel regarding its investigation into the Office of Inswetor and Auditor investigation and report of investigation against dessrs. Caldwell-and Kelly. This would include, but not limited to, any statements or notes taken during interviews of witnesses or 2 0 employees, any L
transmittals from the Office of Inspector and Auditor to the Office of General Counsel, and any final or draft report; The Union needs this information in order to determine whether or not the Agency is in possession of any exculpatory evidence and in order to determine whether or not the 20 found the investigation l

Any materials concerning alle9ations of, or proven (administrative or otherwise) improper or unsatisfactory conduct on the part of Mr.
Richard L. Bangart, Director Division of Radiation Safety and Safeguards regarding his involvement with the South Texas (Nuclear)
Project or with his stpervisory role over NRC inspectors at the ST(N)P.

The Union needs this information in order to determine whether or not Mtc management has failed to discipline individual enployees on an equitable basis and in order to determine whether or not Messrs.
Caldwell's or Kelly's alleged actions at STP were known to management in advance of the OIA investigation. Further, Mr.
Bangart's credibility will be a key issue in any potential l
grievance / arbitration.

Copies of all Office of Investigations report of investigations into mismanagement by Houston Lighting and Power / South Texas Project and l:
Brown and Root / South Texas Project.
4 The Union needs this information in order to demonstrate that Messrs. Caldwell and Kelly were responsible for discovery of several discrepancies and/or deficiencies in the STP security program. The j
Ur. ion will raise as a defense that because Messrs. Caldwell and Kelly performed their jobs as inspectors in a fully successful j
manner, thereby uncovering severe deficiencies in the utilities security program and rightfully causing delays in licensing, the i
Agency retaliated against them in proposing discipline. The 0/I report of investigation will corroborate the reported mismanagement.
