SECY-81-449 - NRC Jurisdiction Over Activities in Certain Offshore Waters (Rulemaking Issue)

The Comission, by a vote of 4-0 (Commissioner Gilinsky not participa. ting),

approved publication in the Federal Register of a final rule to clarify NRC jurisdiction vis-a-vis that of Agreement States over persons performing operations using by-product, source and special nuclear materials in certain offshore waters.

SECY-81-476 - Approval Under Section 145b of the Atomic Energy Act of 1954, as Amended, for the Employment of Ms. Katherine S. Powell as Administrative Assistant and Ms. Jessica H. Laverty as Staff Counsel to Commissioner Thomas M. Roberts and Access to National Security Information and Restricted Data (Policy Issue)

The Commission, by a vote of 4-0 (Commissioner Gilinsky not participating):

determined that the employment of Ms. Powell and Ms. Laverty and permitting them access to National Security Information and Restricted Data is clearly consistent with the national interest; and 2.

based on the above determination, granted Ms. Powell and Ms. Laverty an NRC "Q"-access authorization.

III. Order Regarding Petition to Intervene in Philippines Export (SECY-81-427 is a related paper on the Philippines export licwnse.)

The Comission deferred affirmation of this iteni and requested that any pending Commissioner questions on the export license be circulated.

Subsequently, affirmation of the Order was rescheduled for a Commission meeting on August 20, 1981.

IV.

SECY-81-454 - Issuance of Order in TMI-l Restart Proceeding (Adjudicatory Issue)

In a closed session, the Commission, by a vote of 4-0 (Commissioner Gilinsky not available to participate), approved a portion of an Order authorizing NRC staff to issue an amendment to the TMI-l operating license which will

transfer authority to operate the facility to GPU Nuclear.

(Subsequently, the Order was signed by the Acting Secretary.)

The Comission requested that the following language be included as a footnote on page 1 following this statement:

"The Atomic Energy Commission (the Comission) having found thatl IThese findings are virtually of no present significance.

The license authorizing GPU Nuclear to operate TMI, Unit 1, is suspended pending the outcome of the TMI-l restart proceeding. That proceeding will determine whether GPU Nuclear is qualified to operate the facility. Issuance of an amendment, dated (to be filled in by staff),

authorizing GPU Nuclear to assume the prior responsibility of Met Ed under the license, is not intended to influence or otherwise prejudice that proceeding.

Subsequently, a meeth.g was scheduled on August 18, 1981, to discuss the delegation of appellate review authority to an Appeal Board.
