SECY-81-430 - APPROVAL Of AgPROPOSED LICENSE TO EXPORT HIGH ENRICHED URANIUM TO THE FEDERAL REPUBLIC OF GERMANY (LICENSE NO. XSNM01808)

This is to advise you that the Commissioners have reviewed the subject license to Transnuclear, Inc.

The Commission (with three Commissioners approving) has accepted your recommendation to export to the Federal Republic of Germany 31.3 kilograms of uranium, enriched to 93.3% U-235, and 64.7 kilograms of uranium, enriched to 45.4% U-235, in the form of UF6*

In connection with his approval, Chairman Palladino has provided the following statement:

"I am concerned about the use of highly enriched uranium in research reactors and the relationship of the Commission's expert licensing responsibilities to it.

I am heartened by the efforts to phase out the use of HEU in such reactors, and believe such efforts should be accelerated.

I request that the Commission direct the staff to prepare a policy statement for Commission consideration on this general subject."

The other Commissioners have concurred in this request.

Commissioners Gilinsky and Bradford have approved only 64.7 kilograms of 45% material and are not satisfied with the justification for further fuel shipments.

They would wait to see if special circumstances develop which would warrant shipment of additional HEU.

The Commission requests that the staff provide the policy statement requested by Chairman Palladino by September 22, 1981.

The Office of International Programs was informed of this action by telephone on September 2, 1981.
