SUBJECT:
OUTSIDE EMPLOYMENT OF AN NRC RESIDENT CLERICAL AIDE AS A PART-TIME SECRETARY FOR THE STATE lhSPECTOR AT MAINE YANKEE I have reviewed your August 11, 1989 memorandum *recuesting EDO approval for Ms. Faulkingham to continue outside employment.as the part-time secretary for the State Inspector at Maine Yankee.
I also asked the Office of the General Counsel for their review and recommendation.
I do not believe, as a matter of policy, that it is apprcpriate to allow NRC employees to also work for state acencies which are involved in areas which NRC regulates, particularly when the same licensee is involved. While extraordinary measures could be taken to minimize the chance of a real conflict of interest, there still could be the appearance of a conflict of interest, particularly if a controversial issue arose. Therefore I cannot approve the continued employment by Ms. Faulkingher. with the State. However, because of the background in this case and in fairness to Ms. Faulkingham, I will allow her untti April 1,1990 to resolve the conflict.
I would consider an extension within 30 days of this deadline if extenuating circumstances warrant.
In the interim, please take appropriate measures to ensure a conflict of interest situation does not arise.
