SUBJECT:
OUTSIDE EMPLOYMENT WITH STATE INSPECTOR AT MAINE YANKE NRC regulations require advance approval of outside employment where a conflict of interest or potential conflict of interest exists. NRC Region 1 management improperly advised you regarding your inquiry as to acceptability of outside employment. Based upon the Region I advice, you accepted outside

employment.
Subsequently you were advised of the requirement to obtain approval. of the Executive Director for Operations (E00) to continue your j
cutside employment.
On July 24 1989 you requested, pursuant to 10 CFR Part 0 Section 0.735, the ED0's approva,l to continue outside employment as a part-time secretary for the State Inspector at Maine Yankee.
The Acting Executive Director for Operations, James M. Taylor, has determined that your outside employment as a part-time secretary for the State Inspector at Maine Yankee is a conflict of interest, or could give the appearance that

it is a conflict of interest.
l It is inappropriate for NRC employees to also work for state agencies which are involved in areas which NRC regulates, particularly when the same licensee is involved.
Because of the circumstances in your case, you will be given until April 1, 1990, to rcsolve the conflict.
i If extenuating circumstances warrant and with prior notice, I will consider an extension of this deadline.

If you have not made a decision by the time specified above, I will propose your removal from your position at the Nuclear Regulatory Commission.
In the interim, I trust that you are taking appropriate measures to ensure that a conflict of interest situation does not arise.
