MEETING WITH R0GER FORTUNA ET AL TO DISCUSS AGENCY RESPONSE TO JOHN T. B0ESE LETTER TO FORTiINA 0F JULY 9,1982 REQUESTING THE RETURN OF HAYWARD TYPLER PUMP CO. DOCUMENTS GIVEN TO AGENCY INVESTIGATORS On Tuesday, July 20, 1981 a meeting was held at 9:00 a.m. in East-West with-Roger Fortuna, Alex Dromerick, Mark Peranich, George Georgiev, IE; Ed Shomaker, Neal Abrams, ELD; Joe Felton, Carol Ann Reed, DRR.

The subject of the meeting was the July 9, 1982 letter from John Boese where HTPC and its ccunsel--Fried, Frank, Harris, Shriver & Kampelman--sought the inmediate return of documents that HTPC had provided to NRC inspectors pursuant to the NRC's ongoing investigation. Mr. Boese further offered to retain the returned documents in'a special file in his offices where access to the file would be allowed for any " responsible NRC officials."

Implicit in Mr. Boese's letter was the indication that NRC officials would not be given copies of HTPC documents in the future.

The individuals at the meeting discussed several options for responding to Mr. Boese's letter and the following items were agreed upon:

1.

The NRC should not avail itself of a " safe house" at the Watergate.

2.

Three categories of HTPC documents existed (1) documents of such worth that they will be attached to the investigative report; (2) documents that will be quoted extensively in the investigative report; (3) documents that were reviewed by the investigative team but which do.

not form the basis for any NRC conclusions or findings.

The documents in category (3) can be returned to HTPC, but documents in categories (1) and (2) must be retained by the NRC as they fonn the basis for agency action.

The NRC still needed 10 or 15 identified documents from the HTPC.

At the close of the meeting Mr. Fortuna stated that he would speak 'with IE management and determine the exact method of responding to Mr. Boese's July 9, 1982 letter.

. response to the letter be in the form of an informal phone call between Mr. Fortuna and Mr. Soese. Mr. Fortuna was directed to relate the fiRC position and request the additional documents from HTPC.

That phone conversation took place on July 21, 1981.

The counsel for HTPC accepted the NRC position that document categories (1) and (2) would be I

r,aintained by the !?RC and promised to provided the NRC with the remaining requested documents.

Mr. Fortuna is still awaiting those requested documents.
