RESOLUTION OF SUFFOLK COUNTY CONTENTIONS EP 7(A) -- ONSITE RESPONSE ORGANIZATION (EMERGENCY DIRECTOR / RESPONSE MANAGER)

AND EP 8 -- EMERGENCY OPERATIONS FACILITY THIS AGREEMENT by and among Long Island Lighting Company ("LILCO"), the Nuclear Regulatory Commission Staff

(" Staff"), Suffolk County ("the County" or "SC"),

the Shoreham Opponents Coalition (" SOC"), and the North Shore Committee

("NSC") (hereinafter collectively the " Parties") resolves Suffolk County Contentions EP 7(A) and EP O in accordance with the terms stated below, subject to the approval of the Atomic Safety and Licensing Board (" Licensing Board").

In Suffolk County Contention EP 7(A), the County had expressed concerns that the LILCO plan does not clearly define and distinguish between the functions of the Emergency Director and the Response Manager.

s' clarification regarding the shift of overall emergency response duties from the Emergency Director to the. Response Manager.

Suffolk County Contention EP 8 concerns the Emergency Operations Facility (EOF) for the Shoreham Nuclear Power Station.

The County has alleged in EP 8 that: (A) the Shoreham Emergency Plan (" Plan") does not state that the EOF will achieve operational readiness within the time suggested in NUREG-0696; (B) there is no provision in the Plan for obtaining seismic information at the EOF; and (C) the Plan does not indi-cate that the EOF will be activated at an early period during an accident, leading to concern that the EOF would not be available on a timely basis later in an accident when a fully functioning EOF would be required.

By this Resolution agreement, LILCO agrees to respond to the County's concerns in Contentions EP 7(A) and EP 8(A) and.

(C), above, by amending the second paragraph of 7.1.3 of the Plan (pp. 7-2 to 7-3) to read as follows:

The EOF is activated upon the declaration of a Site Area or General Emergency.

It may also be activated during an Alert Emergency at the discretion of the Response Manager after consultation with the Emergency Director.

Upon declaration of an Alert Emergency, the Emergency Planning Advisor No. 1 will report promptly to the EOF and either place the facility in a standby status or activate it as directed.

Upon declara-tion of a Site Area or General Emergency, the Emergency Planning Advisor No. 1 will 2_

report promptly to the EOF and activate the facility.

The EOF shall achieve operational readiness one hou,r after activation and assume the following responsibilities under the direction of the Response Manager:

1.

Management of corporate emergency response resources.

2.

Radiological effluent and environs monitoring, assessment and dose projections.

3.

Flow of information and protective action recommendations to Federal, State and County response organizations.

4.

Management of recovery operations.

The EOF may be activated during an Alert at the discretion of the Response Manager as stated in the Plan.

In addition, in response to the County concern regarding the availability of seismic data in the EOF ((B),

above), LILCO has provided the following information.

Seismic,

monitoring is discussed in Section 7.3.1 of the LILCO Plan.

Seismic monitoring will be accomplished by a time history acceleration system which records triaxial acceleration from three discrete lccations.

The time history acceleration system will provide an audible and visual annunciation to the Control Room operator.

The Control Room has several communication capabilities with the TSC and EOF and can thus provide seismic information to these locations as required.

Based upon LILCO's agreement to add to the Plan the

language described above, SC finds that SC Contentions EP 7(A) and EP 8 are rer.olved.

As a result, the Parties jointly urge the Licensing Board to accept this Resolution to terminate litigation of SC Contentions EP 7(A) and EP 8.
