h1INUTES OF CONFERENCE C ALL INITIATE D BY CHAIRNIAN RIGLER ON JULY 28, 1975 On July 28, 1075, Chairman Douglas Rigler initiated a conference call participated in by htr. Rigler, hir. Roy Lessy for the Nuclear Regulatory Commission Staff, hir. Steven Charno for the Department of Justice, hir. Bradford Reynolds for the Applicants and hir. David Hjelmfelt for the City of Cleveland.

hir. Rigle r announced that the purpose of the call was to state the Board's position with respect to the Department of Justice's hiotion for Reconsideration of the Board's Order establishing procedural dates. The Board asked the parties to proceed on the bas; 4 of the established dates at this time. On or about August 20, 1975, a conference would be held to dete rmine whethe r the parties believed the established date s could be met.

The Chairman stated that the Board did not wish to push the parties to an unreasonable hearing date. Chairman Rigler said other parties could file a response to the Denartment's motion if they so desired.

The Chairman announced that the Board was prepared to rule on hir. Niilburn's hiotion to Quash Subpoena. He inquired whether any party other than Staff desired to file a response. No party planned to file a response.

Nir. Reynolds asked whether the Board was prepared to rule on consolidation of the Davis-Besse Units 2 & 3 proceedings. Nir. Rigler replied that the Board would issue an order very shortly ruling on con-solidation. In the meantime the Chairman advised the parties that they should proceed on the basis that consolidation would be ordered.
