Dear Mr. Stolz:

On December 3, 1976, Florida Power Corp. was issued Facility Operating License No. DPR-72 limiting operation of the plant to the refueling mode of operation and the cold shutdown mode of operation. These are referred to as Modes 6 & 5 as defined in Standardized Technical Specifications (STS).

We herewith apply to the Nuclear Regulatory Commission to modify the opera-ting license DPR-72 to allow operation in the modes 1 thru 6 up to 2452 MW thermal power.

In making this application, we would summarize our activities which alleviate concerns explicite to the reasons for limiting the license to Modes 5 & 6.

These concerns are expressed in various places in the license and not just those listed in the SER Supplement No. 2 Conclusions.

1. On Dec. 7, 1976, we filed the Final Structural Integrity Test Report.

2. Filed on Dec. 10, 1976:

(a) Confirmation of B&W Topical Report 10103 preliminary informa-tion evaluated by staff and subsequent revision as applicable to Crystal River #3. (Snall breaks analyses re: ECCS.)

(b) Confirmation of B&W Topical Report 10104 revision information to be supplied to Staff on Dec. 17, 1976 as being applicabic

. water storage tank level instrumentation to qualify the systems by submittal of details of the modification and a schedule for such a modification.

(e) Filed the " Reactor Containment Building Pre-operational Inte-grated Leak Rate Test" report No. 1927, thus closing this concern.

.(f) Filed proposed FSAR revision to present information required to accept the results of the onsite testing of the hydrogen purge system. These revisions will be incorporated in the next amendment to the FSAR.

(g)' Filed pages to convert our interim " Reactor Building Dome Delamination" report to our final report. This closes our submittal of "as built" information.

(h) Submitted confirmation of completion of flow measurement testing to assure the 40 gpm flow rate in the decay heat drop line as re-quired by appropriate accident analysis.

3. .We had previously submitted on Dec. 2,1976 our available operating procedures and design provisions which will make the likelihood of a pressure transient exceeding the temperature-pressure 1Lnits of the reactor vessel acceptably small.

4. Other items of concern in the SER and other attachments have been discussed in detail with staff and we are advised that nothing more is required at this time from the licensee for completion of their evaluation and release from Modes 5 & 6.

5. We submitted on Sept. 22, 1976 for review the cpplicant's efforts to be in compliance with 50.55 (a) Provisions. Required procedure revision preview, potentici need for additional instrumentation and required time to accomplish the meeting of intent as we interpreted compliance were impossible to effect immediately. Compliance is still our intent and the licensee is presently. continuing his assessment of how to carry out the code interpretations. To eliminate untimely interpretive conflict between the licensee and the office of Inspection and En-forcement the applicant seeks temporary written reitef to accomplish the production of implementation procedures as stated in SER Section 5

. 5 and feels this relief is appropriate and justified during the required interim period.

As of this filing date we . ave successfully loaded all fuel elements and work is proceeding to close the reactor pursuant to leaving Mode 6 & S.

We feel'that the above submittals provide staff with the necessary information

. to establish justification that the Crystal River Unit 3 facility operating
