INVITATION TO PARTICIPATE AS A COOPERATING AGENCY IN THE PREPARATION OF AN ENVIRONMENTAL IMPACT STATEMENT FOR THE PROPOSED HOLTEC CONSOLIDATED INTERIM STORAGE FACILITY, LEA COUNTY, NEW MEXICO (DOCKET NUMBER: 72-1051)

Dear Ms. Roose:

The purpose of this letter is to invite the New Mexico Environment Department (NMED) to participate as a cooperating agency in the U.S. Nuclear Regulatory Commission (NRC) staffs preparation of an Environmental Impact Statement (EIS), pursuant to the National Environmental Policy Act of 1969, as amended. The NRC is reviewing an application from Holtec International (Holtec) requesting authorization to construct and operate a HI-STORE Consolidated Interim Storage Facility (CISF) for spent nuclear fuel at a site in Lea County, New Mexico. The NRC requests NMEDs participation developing the EIS for the application review.

Enclosed is a Memorandum of Understanding (MOU) between NRC and NMED for the environmental review. The purpose of the MOU is to establish a framework for coordination and participation between the two agencies to ensure the timely review of the proposed CISF application. Cooperation between the NRC and the NMED on the Holtec application will ensure that the environmental review of the proposed licensing action will include the special expertise of the NMED staff. The general roles and responsibilities of the NRC (as lead agency) and the NMED (as cooperating agency) in developing an EIS for the Holtec CISF are provided in the enclosed referenced MOU.

The NRC requests your signature as a party to this MOU for the duration of the environmental review. The MOU will become publicly available upon receipt of your signature.
