Dear Ed Mayer:

By letter dated May 9, 2023 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML23055B114), the NRC issued Materials License No. SNM-2516 to Holtec International for construction and operation of the HI-STORE Consolidated Interim Storage (CIS) Facility, in Lea County, New Mexico, in accordance with the requirements of Part 72 of Title 10 of the Code of Federal Regulations (10 CFR Part 72), Licensing Requirements for the Independent Storage of Spent Nuclear Fuel, High-Level Radioactive Waste and Reactor-Related Greater than Class C Waste.

In connection with the issuance of the license, the NRC issued a public final safety evaluation report (SER) (ML23075A183), documenting the staffs findings of compliance with applicable regulations. In addition to this public SER, the staff has also issued the enclosed non-public SER, which documents its compliance findings regarding the physical security, security training, and safeguards contingency plans for the HI-STORE CIS Facility.

The enclosed SER contains safeguards information (SGI), as described in 10 CFR 73.21, and will be withheld from public disclosure. This information is being provided for your information only and, thus, no action or written response to this letter is required.
