VBWR & EVESR: Acceptance of Partial Site Release Approval Request (EPID# L-2019-DSR-0000):

Dear Mr. Murray:

By letter dated December 14, 2018 (ADAMS Accession # ML18348A425) GE Hitachi Nuclear Energy (GEH) submitted a request for approval of a partial site release of an non-impacted area of the GEH Vallecitos Nuclear Center (VNC) along a proposed easement along the State Route 84 highway frontage section to be used for highway widening. The VNC contains land area that is related to NRC power reactor license DPR-1, docket 50-18 (VBWR) and NRC power reactor license DR-10, docket 50-183 (EVESR).

The purpose of this e-mail is to provide the results of the U.S. Nuclear Regulatory Commission (NRC) staffs acceptance review of this approval request. The acceptance review was performed to determine if there is sufficient technical information in scope and depth to allow the NRC staff to complete its detailed technical review. The acceptance review is also intended to identify whether the application has any readily apparent information insufficiencies in its characterization of the regulatory requirements or the licensing basis of the facilities.

The NRC staff has reviewed your request and concluded that it does not provide technical information in sufficient detail to enable the NRC staff to complete its detailed technical review and make an independent assessment regarding the acceptability of the proposed partial site release in terms of regulatory requirements and the protection of public health and safety and the environment.

Specifically, the requests refers to a report by Baseline Environmental Consulting (identified as reference 1 in the request) that appears to contain more detail about sample collection and analysis that supports that there is no radioactive material that exceeds background screening levels in the highway 84 easement area. Please provide a copy of this report on the docket that the NRC staff will use in evaluating your request. Once this report has been submitted to NRC, your request will be considered acceptable for review by NRC.

Given the lesser scope and depth of the acceptance review as compared to the detailed technical review, there may be instances in which issues that impact the NRC staffs ability to complete the detailed technical review are identified despite completion of an adequate acceptance review. If additional information is needed, you will be advised by separate correspondence.

The NRC staff expects to complete this review by approximately August 2019. If there are emergent complexities or challenges in our review that would cause changes to the initial forecasted completion date, the reasons for the changes, along with a new estimate, will be communicated during our routine interactions.
