CALLAWAY PLANT, UNIT NO. 1 -LICENSE CONDITION ASSOCIATED WITH LICENSE AMENDMENT REGARDING ADDITION OF NEW TECHNICAL SPECIFICATION 3.7.20, "CLASS 1E ELECTRICAL EQUIPMENT AIR CONDITIONING (A/C) SYSTEM" (EPID L-2018-LLA-0062)

Dear Mr. Diya:

By application dated March 9, 2018 (Agencywide Documents Access and Management System (ADAMS) Package Accession No. ML18068A685), as supplemented by letters dated January 23, 2019, and February 8, 2019 (ADAMS Package Accession Nos. ML19024A469 and ML19039A352, respectively), Union Electric Company (dba Ameren Missouri, the licensee),

requested the addition of a new Technical Specification (TS} to the Callaway Plant, Unit No. 1 (Callaway) operating license.

The license amendment request proposes a new TS to address the operation of the room cooling for essential electrical equipment. Specifically, the proposed amendment would add new TS 3.7.20, "Class 1E Electrical Equipment Air Conditioning (A/C) System," including (1) a Limiting Condition for Operation (LCO) statement, (2) an Applicability statement, during which the LCO must be met, (3) Actions to be applied when the LCO is not met, including Conditions, Required Actions, and Completion Times, and (4) Surveillance Requirements with a specified Frequency to demonstrate that the LCO is met. In addition, the proposed amendment also revises TS 5.5.11, "Ventilation Filter Testing Program (VFTP)," Item "e" in the Administrative Controls section of the Callaway TSs, wherein the value specified for the wattage required to be dissipated by the heater in each control room pressurization train is proposed to be changed from 15 +/- 2 kilowatts (kW) to 5 +/- 1 kW. of the supplemental letter dated January 23, 2019 (ADAMS Accession No. ML19024A475), provided a list of regulatory commitments, which superseded the regulatory commitments provided as Attachment 6 of the application dated March 9, 2016 (ADAMS Accession No. ML18068A692). The U.S. Nuclear Regulatory Commission (NRC) staff has determined that completion of the commitments and the implementation of the amendment's modifications are essential to the operability and performance of the new system and its related TS change. Therefore, if the amendment is approved, the NRC staff intends to elevate all of the commitments in Attachment 5 of the letter dated January 23, 2019, as a condition of the license by referring to it in a future Section 2.C.18. Please provide revised TS markup pages, and TS clean pages to supplement the amendment, accordingly, by March 8, 2019.

F. Diya The proposed license condition was discussed with Mr. Tom Elwood of your staff on February 13, 2019. To support the issuance of the safety evaluation in a timely manner, Union Electric Company should review the regulatory commitments in Attachment 5 of the supplemental letter dated January 23, 2019, to prevent any unintended consequences of their use as license conditions. The review should be reflected and confirmed in a letter submitted by March 8, 2019. It should be noted, however, that the licensee's confirmation of the license condition format does not constitute completion of the NRC staff's review or approval of the proposed license amendment.
