OF JUNE 29, 2015, MEETING WITH BEYOND NUCLEAR, ET. AL.,

REGARDING ITS 10 CFR 2.206 PETITION REQUESTING ENFORCEMENT ACTION AGAINST THE JAMES A. FITZPATRICK NUCLEAR POWER PLANT (TAC NOS. ME8189)

On June 29, 2015, a Category 3 public meeting was held between the U.S. Nuclear Regulatory Commission (NRC) and representatives of Beyond Nuclear, et. al. (the petitioners), at NRC Headquarters, One White Flint North, 11555 Rockville Pike, Rockville, Maryland. The purpose of the meeting was to provide the petitioners an opportunity to address the NRC Petition Review Board (PRB) in accordance with Management Directive (MD) 8.11, "Review Process for 10 CFR 2.206 Petitions." The meeting notice and agenda dated June 11, 2015, is available in the Agencywide Documents Access and Management System (ADAMS) at Accession No. ML15177A075. A list of attendees is provided as Enclosure 1.

On March 9, 2012 (ADAMS Accession No. ML12074A032), as supplemented on March 13, (ADAMS Accession No. ML12079A036), and March 20, 2012 (ADAMS Accession No. ML12081A284), the petitioners submitted a joint petition to the NRC, under Title 10 of the Code of Federal Regulations, Part 2.206, regarding the James A. FitzPatrick Nuclear Power Plant.

The petitioners also submitted a Freedom of Information Act (FOIA) request dated October 11, 2012, requesting various communications between the NRC Office of Nuclear Reactor Regulation (NRR), the Office of General Counsel, Region I, and the resident inspectors. The staff satisfied this request from the petitioners with a response on August 7, 2013 (ADAMS Accession No. ML13154A313). The petitioners stated that this information was necessary in order to address the PRB for a second time.

As described in MD 8.11, the petitioners are provided the opportunity to address the PRB in order to provide any relevant additional explanation and support for their petition after the PRB has communicated its initial recommendation. The purpose of this meeting was to provide the petitioners another opportunity to address the PRB provide additional relevant explanation and support for the petition request in light of the PRB's initial recommendation, and the information contained in the FOIA request and response.
